Terms of sale

  1. Acceptance of the Terms

The customer acknowledges having read, at the time of placing the order, the specific terms and conditions of sale set out on this screen and expressly declares that they accept them without reservation. These general terms and conditions of sale govern the contractual relationship between 68° and its customer, both parties accepting them without reservation. These general terms and conditions of sale shall prevail over any other terms appearing in any other document, except in the event of a prior, express and written waiver.

  1. Orders

Presentation of items: 68° endeavours to present and describe its items as precisely and accurately as possible. However, any possible error or omission may not be attributed to 68°, and under no circumstances may 68° be held liable on this ground. Photographs and videos may not be asserted against 68°.

Orders: 68° reserves the right not to record a payment and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, difficulty concerning the order received, or an existing dispute relating to payment of a previous order. The information provided by the buyer when placing the order is binding on the buyer. In the event of an error in the recipient’s contact details, the seller may not be held liable for any inability to deliver the product.

  1. Delivery

After confirmation of the order, 68° undertakes to deliver all items ordered by the buyer to its carrier. This carrier undertakes, under its contract with 68°, to deliver the order to the buyer’s address provided by 68°.

For deliveries outside metropolitan France, the customer undertakes to pay all taxes due upon importation of the products, customs duties, value-added tax, and all other taxes due under the laws of the country receiving the order.

All orders placed with 68° are intended for the customers’ personal use; customers or recipients of the products undertake not to resell the products, in whole or in part. 68° shall thereby be released from any legal liability if the taxes are not paid by the customer.

In general, we need 1 to 4 days to process an order, after which it is shipped. The shipping time depends on your country and shall not exceed 10 days.

In accordance with the Consumer Code, the customer may terminate the contract if the delivery date is exceeded by more than 7 days and this is not due to force majeure. War, riot, fire, strikes, accidents and the impossibility of obtaining supplies are considered cases of force majeure releasing the seller from its obligation to deliver. In accordance with the Consumer Code, 68° is responsible for the proper transportation of the products and, generally, for the proper performance of the contract.

Thus, except in cases of force majeure, the customer shall not be required to establish the fault of other parties involved in the event of improper performance of the contract. Customers are advised to systematically check the parcel upon arrival and refuse any damaged parcel. The customer has 48 hours to make any reservations with the carrier in the event of missing items or damage. For availability reasons, an order may be delivered to the customer in several shipments. The customer then pays for only one delivery. If the customer wishes to have deliveries made to two locations, two orders must be placed, with the related delivery charges.

In the case of deliveries by a carrier, 68° may not be held liable for a delivery delay due exclusively to the customer’s unavailability after several appointment proposals.

  1. Withdrawal

In accordance with the provisions of Article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from receipt of your products in which to exercise your right of withdrawal without having to provide reasons or pay a penalty.

Returns must be made in their original and complete condition (packaging and accessories) to the following address: 68°, 13 impasse les Noyers, F-01400 Chatillon sur Chalaronne, with a tracking number, in order to avoid parcels being lost or misplaced by carriers. You must provide us with the tracking number of your returned parcel, failing which we will refuse the return.

Any damage sustained by the product on this occasion may be such as to defeat the right of withdrawal. Return costs shall be borne by the customer.

In the event that the right of withdrawal is exercised, 68° shall refund the amounts paid within a maximum period of 14 days following notification of your request and by the same means of payment as that used for the order.

  1. Prices

All prices displayed on the site are in euros, including all taxes. 68° reserves the right to change its prices without notice, and the prices charged to the Customer shall correspond to those displayed on the site at the time the order is placed. The goods shall remain the full property of 68° until receipt of payment in full of the total amount due from the Customer. The price indicated on the product pages does not systematically include transportation.

  1. Payment

The price invoiced to the customer is the price indicated in the order confirmation sent by email by 68°. The price of the products is payable in full on the day the order is placed. Payment may be made by bank card or PayPal.

Payments by bank card, Apple Pay, Google Pay, etc. are processed by our partner Shopify. To place an order, you do not leave our site and no card data is stored on our servers. Shopify uses the highest level of certification for online payment: PCI-DSS Level 1 certification (Payment Card Industry Data Security Standard). At no time does 68° have possession of your banking details, and the entire transaction is fully encrypted using SSL encryption.

You may also choose to pay for your purchases via PayPal, either using your PayPal account or directly by bank card without needing to create an account. PayPal is the leading electronic wallet system, recognized worldwide for its reliability.

PayPal automatically encrypts your confidential information using the Secure Socket Layer (SSL) protocol with a 128-bit encryption key, which is the highest level available.

Your payment information, and in particular your bank card details, are at no time made known to 68°: the transaction takes place directly with Shopify or PayPal, which only informs us whether the payment has succeeded or failed.

An order validated by the customer shall be considered effective only once the relevant banking payment centres have given their approval. In the event that said centres refuse the payment, the order shall be automatically cancelled and the customer notified by email.

Furthermore, 68° reserves the right to refuse any order from a customer with whom a dispute exists.

  1. Warranty

In the event that a product sold does not conform, it may be returned, exchanged or refunded. All claims and requests for exchange or refund must be made by email via our contact form within 30 days of delivery. The products must be returned to us in the condition in which you received them, together with all components (accessories, packaging, instructions, etc.), in accordance with the provisions specified in Article 5 “Withdrawal”. Shipping costs shall be refunded on the basis of the amount charged, and return costs shall be refunded upon presentation of supporting documents.

  1. Liability

The products offered comply with the applicable French legislation. 68° may not be held liable in the event of non-compliance with the legislation of the country where the product is delivered. You are responsible for checking with the local authorities the possibility of importing or using the products or services you intend to order.

Furthermore, 68° may not be held liable for damage resulting from improper use of the purchased product. Finally, 68° may not be held liable for any inconvenience or damage inherent in the use of the Internet, including service interruption, external intrusion or the presence of computer viruses.

  1. Applicable Law in the Event of Disputes

The language of this contract is French. This contract is governed by French law. In the event of a dispute, the French courts shall have sole jurisdiction. 68° may not be held liable for damage of any kind, whether material, immaterial or bodily, that may result from malfunction or improper use of the products marketed.

In the event of difficulties in applying this contract, before taking any legal action, the buyer may seek an amicable solution, in particular with the assistance of a professional association, a consumer association or any other adviser of their choice. Compliance with the provisions of this contract relating to the contractual warranty presupposes that the buyer fulfils their financial obligations towards the seller. Claims or disputes will always be received with attentive goodwill, good faith always being presumed on the part of the person who takes the trouble to explain their circumstances. In the event of a dispute, the customer shall first contact 68° in order to obtain an amicable solution.

  1. Intellectual Property

All elements appearing on the 68° websites are the exclusive property of 68° and are therefore protected by the Intellectual Property Code and copyright law. Accordingly, any reproduction of a 68° website, in whole or in part, is strictly prohibited.

You may create links to our website if you do so fairly and if this in no way damages our reputation or takes advantage of our goodwill. However, you are prohibited from creating such a link in a manner that suggests a form of association where none exists. Furthermore, it is strictly prohibited to create a link to our website from a website that does not belong to you. We reserve the right to remove links without notice.

  1. Archiving - Evidence

68° shall archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy, in accordance with the provisions of Article 1348 of the Civil Code. 68°’s computerized records shall be considered by all parties concerned as proof of communications, orders, payments and transactions carried out between the parties.
